What is the procedure
when a person is arrested?After arrest, the accused will usually be taken to a
detention facility for booking. This process involves taking
personal information, recording information about the alleged
offence, searching records for previous offenses, taking
fingerprints and photos, and placing in a holding cell.
What are the
bail options for release from
custody?Although in some cases the accused may be held without
any options for release, in most cases, the court or jail will
exercise the following options:

Release the accused without filing charges.

Release the accused on his/her own
recognizance. This is called (being OR'd). The accused is
released with a promise to appear in court at a specified date.

Release the accused by issuing a Citation to
appear in court at a specified date. Note that a Citation may
also be issued prior to booking. |

Set Bail as a condition for release. |
What is Bail?
Bail is a form of monetary security the court uses to
ensure the accused will appear in court at all required appearances.
If the accused appears when required, the court refunds the bail. If
the accused fails to appear, the court keeps the bail, and may issue
a warrant for arrest.
How is the Bail Amount set?
Judges are responsible for setting bail, but because
many people want to get out of jail as quickly as possible, most
jails have standard Bail Schedules which specify the amounts of bail
for different offences. These schedules may vary from county to
county, and are usually set by municipal, superior, and other
judges.
In setting or denying bail, the judge or magistrate's primary
concern is public safety. Other considerations in setting the bail
amount are the seriousness of the offence and the previous criminal
record of the accused.
Can I post Bail myself?
Yes, anyone may pay the full amount of the bail.
However, most people do not have access to the full bail amount
immediately to quickly secure release of the accused. Also, you will
not have access to your funds until all court appearances (through
resolution of the charges) are complete, thereby tying up your funds
for what could be a lengthy period. Another consideration is that
your funds are at risk if, for any reason, the accused fails to
appear at a court appearance.
What is a Surety Bond?
A surety bond (or bail bond) is the form of security posted by a
professional Bail Bond Agency to guarantee the accused will appear
in court. The Surety Company assumes responsibility for the accused,
and guarantees that the full amount of the bond will be paid to the
court if the accused fails to appear at all required appearances.
How much will bail cost?
In the State of California , bail amounts are regulated by the
California Department of Insurance and are typically ten percent of
